NAME
The name of the recreation centre is Bukit Kiara Equestrian
& Country Resort (hereinafter referred to as the "Resort").
CONSTITUTION
The Resort is a proprietary Resort, wholly owned and operated
by Bukit Kiara Resort Bhd (hereinafter referred to as "the
Company") with a Board of Directors (hereinafter referred
to as "the Board") entrusted with the policies,
management and operation of the Resort.
At
the invitation of the Company, licensees of the Company
("Members") may enter, use and enjoy the facilities
of the Resort in common with other Members subject to
the Rules and Regulations of the Resort established by
the Company from time to time.
FORWARD
It is the intent of the Board to limit the Rules and Regulations
to the minimum for the mutual enjoyment of the facilities
of the Resort by all Members and their guests. The obligation
of enforcing these Rules and Regulations is placed in
the hands of carefully, selected and trained employees
of the Company to assure the Members of such courtesies,
comforts, privileges and services which a member of a
fine, private Resort is entitled.
For
the benefit of all Members, it is the duty of Members
to know the Rules and Regulations of the Resort and to
cooperate with the Company and its employees in the enforcement
thereof.
INTERPRETATION
In these Rules and By-Laws the following words and expressions
shall where the context so admits be deemed to have the
following meanings:
| "Board" |
means
the Board of Directors of the Company. |
| "Company" |
means
Bukit Kiara Resort Bhd and includes its successors-in-title
and persons deriving title thereunder. |
| "License
Agreement" |
means
the License Agreement made between a Member and the
Company conferring upon the Member the License to
enter use and enjoy the facilities of the Resort. |
| "License" |
the
license to enter use and enjoy the facilities of the
Resort granted to any category of Member including
but not limited to those referred in Rule 5 below. |
| "Nominee" |
means
a person nominated by the Licensee in accordance with
the terms of the License Agreement to enjoy the Privilege. |
| "Management" |
means
the management staff of the Company or such other
body of persons to whom the Company has delegated
the management of the Resort. |
| "Member" |
means
any licensee of the Company who has been conferred
the License by the Company to, subject to the provisions
of the License Agreement and these Rules, enter use
and enjoy the facilities of the Resort. |
| "Family
Members" |
means
one lawful spouse of the Licensee or nominee and the
Licensee's or Nominee's lawful children under the
age of eighteen (18) years, if any. |
| "Resort" |
means
Bukit Kiara Equestrian & Country Resort. |
| "Rules" |
means
the Rules herein set out and includes any amendment
or modification thereto and any new Rule promulgated
and any by-laws and regulations which the Company
may make at any time and from time to time. |
The
headings in this Rules are for ease of reference only
and shall not be taken into account in the construction
or interpretation of the Rule to which they refer.
Words
of the masculine gender include the feminine and neuter
genders and words denoting natural persons include corporations
and firms and all such words shall be construed interchangeably
in that manner.
Words importing the singular meaning where the context
so admits include the plural meaning and vice versa.
